These general terms and conditions (T&C) govern the rental relationship between Noor Car Rental and the customer. They apply to all vehicle rentals concluded via our website, by phone or by email. By booking, you accept these terms. Together with the rental agreement, you also receive them as a PDF with your booking confirmation.

Scope
These general terms and conditions (T&C) govern all rights and obligations arising from the rental relationship between Noor Car Rental (hereinafter the 'lessor') and the renter. The lessor and contracting party is:

Conclusion of contract and booking
Bookings are made via our website, by phone or by email. For online bookings, the rental contract becomes binding once the lessor has received the rental payment and the renter has received the booking confirmation by email.
For bookings by phone or email, the rental contract is concluded with the lessor’s written booking confirmation. Here too, the rental must be paid before the vehicle is handed over (see 'Rental price and payment').
At vehicle handover, the written rental agreement is additionally signed. The renter receives it, together with these terms, in advance as a PDF with the booking confirmation.

Requirements for renting
The renter and every driver must:
- be at least 21 years old
- hold a valid driving licence (for at least one year)
- present a valid identity document (identity card or passport)
- present a credit card in their own name (for the deposit)
- provide all information truthfully
The lessor may refuse rentals without stating reasons.

Authorised drivers
The vehicle may only be driven by the renter and the additional drivers listed in the rental agreement. The renter is liable for these persons as for themselves.
Additional drivers can be added for a small fee and must meet the same requirements.

Rental period, handover and return
The rental begins with the handover of the vehicle and ends with the return of the vehicle including keys. Late returns result in additional rental costs.
Handover takes place in Gettnau (Lucerne region) by default. Handover at Lucerne railway station or at the airport is possible by arrangement.

Rental price and payment
The prices valid at the time the contract is concluded apply. For online bookings, the rental is paid in advance via our secure payment provider.
The rental must be paid in advance in all cases. If payment is not made through the website – for example for bookings by phone or email – the full rental amount must have been received by the lessor before the vehicle is handed over. What counts is the receipt of payment, not the date the payment was ordered.
The lessor states the accepted payment method (for example a payment link or bank transfer) and the payment deadline in the booking confirmation. Payment at handover or after the rental is only permitted if the lessor has confirmed this in writing beforehand.
If the rental amount has not been received in full at the time of handover, the lessor is entitled to refuse to hand over the vehicle. In that case the booking counts as a no-show under the section 'Cancellation and rebooking'.
Additional services and subsequent charges are invoiced separately.

Cancellation and rebooking
Cancellations or rebookings are free of charge up to 48 hours before the start of the rental. For later cancellations or no-shows, a one-day flat rate of the booked vehicle is charged; amounts already paid are refunded accordingly.

Deposit
For every booking, a deposit of CHF 200 is reserved on the driver's credit card but not charged. After proper return of the vehicle, the hold is released again.
The lessor is entitled to offset any costs subsequently arising from the rental against the deposit or to invoice them to the renter.

Vehicle condition at handover
By taking over the vehicle, the renter confirms its contractual condition unless damage is recorded in the handover protocol. Photographs taken by the lessor serve as evidence.

Duty of care
The renter undertakes to handle the vehicle with care and to comply with all legal regulations. The vehicle must be locked when not in use.

Prohibited use
The following are prohibited in particular:
- Races, driving tests or sporting events
- Driving under the influence of alcohol, drugs or medication
- Grossly negligent or reckless use
- Subletting
- Use for illegal purposes
- Overloading
- Transport of dangerous goods

Trips abroad
Trips abroad are only permitted with the lessor's prior written consent.

Fuel
The vehicle must be returned with the same fuel level. Shortfalls are charged at market prices plus a service fee.

Mileage
The agreement in the rental contract applies. Additional kilometres are subject to a charge.

Insurance and excess
The vehicles have liability and casco insurance in Switzerland. In the event of damage, the following applies per event:
- CHF 1,000 excess for drivers aged 25 and over
- CHF 3,000 excess for drivers under 25
In the event of gross negligence or breach of contract, the renter is fully liable, including beyond the excess.

Damage not covered
Typically excluded from insurance cover and therefore fully borne by the renter are in particular:
- Tyre and rim damage
- Clutch damage
- Misfuelling
- Loss of or damage to keys
- Interior damage
- Damage caused by incorrect operation

Accident, theft and damage
In such an event, the renter must:
- inform the police immediately
- notify the lessor without delay
- complete an accident report
- not acknowledge any fault

Repairs
Repairs are only permitted with the lessor's express consent.

Traffic violations
The renter is liable for all fines and fees incurred during the rental period. In addition, an administration fee of CHF 20 is charged per case.

Cleaning
In the event of excessive soiling, animal transport or the smell of smoke, special cleaning costs are charged.

Diminished value
In the event of accident damage, a diminution in the vehicle's market value may be claimed in addition to the repair costs.

Loss of use
For the duration of the repair or unavailability, the renter may be invoiced for loss of use.

Loss of vehicle parts
Missing accessories, documents, chargers or vehicle parts are charged to the renter.

Liability of the lessor
To the extent permitted by law, any liability for indirect or consequential damage is excluded.

Data protection
Personal data is used for the performance of the contract and may be passed on to authorities where necessary. In all other respects, the privacy policy on our website applies.

Jurisdiction and applicable law
Should individual provisions of these terms be invalid, the validity of the remaining provisions remains unaffected.
Swiss law applies. The place of jurisdiction is, to the extent permitted by law, the registered office of Noor Car Rental. In the event of discrepancies between language versions, the German version prevails.
